Student Code of Conduct
INTRODUCTION

The purpose of the Student Code of Conduct is to assist students, parents and program staff in maintaining an environment suitable for learning at the Day Program. The Code of Conduct also guides students in developing the personal skills which can help them achieve appropriate goals in relationships, education, and employment away for the Program.

Students are expected to follow these rules to successfully complete the Day Program and to earn privileges such as breaks, extra breaks, and special activities or events at the Program.

St. Clair County Day Program, Inc. students are subject to the Code of Conduct during the school day, at school-sponsored events or trips, and while being transported on school buses. Unless otherwise stated, Day. Program students are subject to the same Code of Conduct as other Pell City and St. Clair County students.

1. ATTENDANCE:

Unexcused absences: -100

Students are expected to come to the Day Program every day on which classes are scheduled. If a student cannot come to school when he or she should, that student or his parent/guardian is expected to call the Day Program (594-2280) before 9:00 a.m., and tell why he/she is not coming. If the student calls in, the reason for the absence will be verified with the parent/guardian. If absent due to illness, the parent/guardian must tell what is wrong and what is being done about the sickness. Students are expected to bring in a court or a doctor’s excuse upon their return to the program. This excuse must state time of arrival to and departure from the appointment.

***Failure to follow these guidelines results in an unexcused absence, or absences, and a conduct score of zero (0) for that day. However, the student will be given the opportunity to make up academic work.

For action on attendance problems, the Day Program follows the guidelines established by the Pell City and St. Clair County Boards of Education in cooperation with the Juvenile Court. The Day Program contacts Juvenile Court Services daily concerning probationers attendance.

2. PUNCTUALITY

Tardy: -30

a. The Day Program starts each scheduled day at 8:10 a.m. Students who arrive any time after 8:10 a.m., are considered tardy.

b. -10 Students arriving at the Day Program site, as part of their transportation arrangement, are expected to enter the building immediately.

c. -10 Students are expected to return to classes immediately after breaks according to the daily schedule.

d. -30 Once inside the Day Program building, no one may leave the building without permission.

3. INAPPROPRIATE INTERACTION WITH ADULTS

a. FOR ARGUING: -10

b. FOR NOT FOLLOWING INSTRUCTIONS: -10

Adults who are staff members of the Day Program, as well as the parent/guardians, or probation officers or any other adult who is working with students or in the building shall be treated with respect. Furthermore, students are expected to follow the instructions or directions of adults and to allow the adults and to help them work out problems that come up.

If students have other ideas or suggestions about how to do what adults have asked, instructed, or directed, they may discuss those ideas or suggestions with adults. However, adults will have the final say about the matter.

c. DISRESPECT: -10

d. FOR TOTAL NONCOMPLIANCE (SEE I.S.S.)

4. INAPPROPRIATE INTERACTION WITH PEERS:

a. HORSEPLAY: -10

b. ARGUING WITH CLASSMATES: -10

(this includes ethnic or racial slurs: -30)

c. DISRESPECT: -10

d. FIGHTING (AUTOMATIC I.S.S.)

Students are expected to get along with each other during program activities or events. When conflicts between students come up, students will be expected to try to work them out among themselves without getting into verbal hostility or physical contact. If students cannot work out conflicts on there own, students will be expected to allow adults to help or even to take control, if necessary. Fighting is not considered an acceptable way to work out conflicts. Furthermore, students are expected to treat each other with respect and not engage in horseplay.

5. OFF TASK: -10

a. During academic or counseling work periods, students are expected to start their work, pay attention to their own work, bring necessary supplies, (i.e., pencils, paper, etc) and complete their work during the time allowed.

b. Students are expected not to distract classmates, for example, by talking, noise, disruptions, etc.

c. UNSUPERVISED AREA: -10

Students are to be only in areas where a staff member is present.

6. INAPPROPRIATE LANGUAGE: -10

Students are expected to show respect for themselves and adults by speaking in words that are considered acceptable in other school settings. Profanity, disrespectful, or vulgar language, expressions, signs, gestures, drawings or writings are not considered acceptable ways of communication.

7. DISRESPECT FOR PROPERTY

a. NOT PUTTING AWAY MATERIALS: -5

b. MISUSE OF MATERIALS: -10

d. MAJOR VANDALISM/MAJOR DESTRUCTION OF PROPERTY (I.S.S.)

($50.00/hour repair and replacement cost at fair market value)

Students are expected to show their respect for others by respecting others’ property and belongings. This includes other students’ personal possessions and work materials; adults’ personal things and work materials; and the furniture, equipment, and materials of the Day Program. Such respect is shown by getting others’ permission to use their things and using those things correctly so they aren’t broken, destroyed, or lost. Furthermore, students are expected to put away their materials at the close of each period or program event.

8. ACADEMIC DISHONESTY (I.S.S.)

Students are expected to be honest and trustworthy. They are expected to do their own work using their own skills. This rule applies to all academic work.

9. DRESS CODE: -15

Students are expected to make an acceptable physical appearance by dressing neatly and meeting basic personal hygiene and grooming standards, (this includes clean-shaven faces, Boy's hair should be cut above the eyebrow, original hair color). Students may not wear hats, caps, or sunglasses while at the Day Program. To assist in creating an acceptable appearance for all students, a uniform dress code will be enforced. Students are allowed to bring only $5 each day. Clothing requirements are as follows:

Shirts: solid white, long or short sleeve, button-up with a collar (knit “golf” shirts are acceptable). If undershirts are worn, they must be solid white.
Pants: solid khaki (sand/tan), shorts are acceptable. Length of shorts must be to the knee.
Belts: belts are required. They must be solid brown or black in color.
Shoes: tennis shoes must be worn that are suitable for athletic activities. Shoe strings will both be black, or both white, tied in a bow.
Jackets: Solid in color. May not be Red, Blue, or Black.

Jewelry, chains, gang graffiti, obscene language, alcohol advertisements,skulls,cross bones, crowns, concert shirts or drug related advertisements printed on clothing are not permitted. Failure to comply with the Day Program uniform dress code may result in immediate dismissal for the day, which will be considered an unexcused absence.

10. TRANSPORTATION: -15

a. Upon admission to the program, students and their parents agree on the specific arrangement by which they will travel to and from the Program in a safe and timely manner. Deviation from that agreed arrangement, requires written or verbal (telephone) permission by the parent/guardian of the student and must be approved by the students probation officer.

b. Students will wait for their transportation inside of the Day Program building and must be signed out by an approved transporter.

11. TELEPHONE USE: -5

Students may use the Day Program business phone only in the event of an emergency situation and with the written permission of a staff member.

12. RESTROOM USE: -15

a. Students are expected to use the student restrooms in a sanitary way. Students are not to use staff restrooms.

b. Students are provided scheduled breaks throughout the day during which bathroom trips should occur or permission from a staff person should be obtained.

13. SNACK BREAKS: -5

a. Students may eat snacks and drink sodas during specially designated breaks during the program day. Snacks and drinks may be bought at the program during these times and consumed in the recreation room only.

b. Snacks may be purchased before First (1st) Period, at regular scheduled break times, and at the end of the school day.

c. Snacks may be purchased on EXTRA breaks.

d. Breaks must be taken in the recreation room unless staff designates otherwise – Do not disrupt other classes or go outside.


14. PROHIBITED MATERIALS AND ACTIVITIES: (I.S.S.)

a. Students are expected to show respect for themselves and others by not having in their possession alcohol, tobacco products, lighters, matches, etc., drugs, drug paraphernalia, or weapons of any kind within the school-zone. Possession of any of these will result in automatic In-School Suspension, notification of proper authorities and parents.

b. Prescription and non-prescription medication is to be turned in to Program staff to ensure that it is taken according to schedule.

c. Students are prohibited from fighting (IMMEDIATE I.S.S.) and criminal activity (IMMEDIATE I.S.S.) or talking about such. Besides point loss, program responses to violations of this rule can include parent conferences, referral to Juvenile Court Services, pressing of charges, and drug/alcohol screens as appropriate. This rule does not apply to individual or group discussions conducted under the authority of staff and following staff guidelines for that discussion.

15. PROHIBITED MATERIALS AND ACTIVITIES

a. Chewing Gum: -10

b. No book bags will be permitted: -15
Any brought in will be taken by Director and returned to student at the end of the year.

c. Beeper or cellular phones: -30

16. EXTENDED NO-BREAK STATUS AND EXCESSIVE LOSS OF POINTS.

Any student who is a no breaker three (3) times during a period of any consecutive five (5) school days or looses one hundred (100) points or more in one day will incur a “strike” resulting in the students probation officer being contacted. Typical consequences for receiving strikes are as follows:

1st strike: 24 hours in Juvenile Detention.
2nd strike: 48 hours in Juvenile Detention.
3rd strike: 72 hours in Juvenile Detention.
4th strike: Appearance before Juvenile Court Judge.

Any label should cover no more than 2 square inches of garment.

17. IN SCHOOL SUSPENSION: (I.S.S.)

Any student will AUTOMATICALLY be placed IN SCHOOL SUSPENSION for:
a. Fighting
b. Total NONCOMPLIANCE
c. Possession of Alcohol
d. Possession of Drugs (ILLEGAL/NARCOTICS)
e. Possession of Weapons
f. Major Vandalism
g. Use of Tobacco (any form) inside the Day building, within the school zone, or on school property (including the bus).
h. Having in possession or passing out to other students any type of pill, tablet, capsule, paraphernalia, etc.
i. Cheating
j. Spitting

Any of the above, alone or in combination, will result in:

IN-SCHOOL SUSPENSION
PARENT/GUARDIAN CONFERENCE
NOTIFICATION OF PROBATION OFFICER

It may also include referral to Juvenile Court Services, pressing of charges, and drug/alcohol screening as appropriate.

Rule Number 14 does not apply to individual or group discussion conducted under the authority of staff and following staff guidelines for that discussion.

If parents do not agree to come in, for a conference, the student will be sent home until parent agrees to meet.

*** NO-BREAK STATUS IS THE RESULT OF SCORING SEVENTY (70) POINTS OR BELOW ON THE POINT BOARD.

NO-BREAK RULES

1. NO-BREAK STATUS BEGINS UPON ENTERING THE BUILDING (check the point board for point totals).

2. NO-BREAK STATUS DOES NOT END UNTIL STUDENT LEAVES FOR THE DAY (his/her regular time).

3. ANY TIME MISSED DUE TO CHECKOUTS OR OTHER REASONS MUST BE MADE UP THE NEXT DAY IN ATTENDANCE.

4. NO-BREAK MEANS MISS ALL BREAKS.

5. STAY IN ASSIGNED NO-BREAK ROOM DURING LUNCHTIME AND ANY OTHER REGULAR BREAK TIMES.

6. NO-BREAKER IS TO SIGN-UP FOR LUNCH UPON ARRIVAL TO D.A.Y. PROGRAM.

7. NO MAGAZINES OR OTHER FORMS OF ENTERTAINMENT ALLOWED.

8. NO CUMMUNICATION AT ALL (verbal, eye contact, hand motions, etc.)

9. WHEN IN NO-BREAK ROOM --- FOLLOW INSTRUCTIONS (if not, student goes immediately to In-School-Suspension ).

10. NO-BREAKERS MAY NOT BRING LUNCH.

11. WHEN IN NO-BREAK ROOM, STAY IN A CHAIR AT A DESK, NOT ON THE FLOOR.

12. NO-BREAKERS WILL NOT SLEEP.

13. DO NOT REARRANGE FURNITURE.

14. BRING WORK TO NO-BREAK ROOM (do not expect to be able to leave to get it --- BRING IT WITH YOU!!!).

15. NO SNACKS CAN BE BOUGHT ON ANY DAY THAT YOU ARE A NO-BREAKER. DO NOT BRING SNACKS FROM HOME.

WHAT HAPPENS WHEN PLACED IN IN-SCHOOL-SUSPENSION (I.S.S.)
(While in ISS, students will be monitored by the Director or through a video monitor.)

1. WHEN STUDENT IS PLACED IN I.S.S., IT IS FOR THREE (3) DAYS. IN ORDER TO BE RELEASED AFTER THREE (3) DAYS, THERE MUST BE COMPLIANT BEHAVIOR AND SATISFACTORY COMPLETION OF ASSIGNED ACADEMIC WORK.

2. ONE DAY WILL BE ADDED FOR EACH DAY OF NON-COMPLIANCE. IF AFTER FIVE (5) DAYS, STUDENT HAS NOT EARNED RELEASE FROM ISS, CHILD WILL BE SENT HOME UNTIL A PARENT CONFERENCE CAN BE HELD.

3. I.S.S. BEGINS UPON ENTRY TO THE DAY BUILDING.

4. STUDENTS WILL BE GIVEN BOTH ACADEMIC AND COUNSELING WORK TO DO WHILE IN I.S.S. (Staff will have these prepared in packets).

5. WORK ON TEXTBOOK CREDITS MAY BE DONE, IF NEEDED.

6. NO COMMUNICATION (VERBAL, EYE, FACE, OR HAND SIGNAL) WITH ANY PEER.

7. STUDENT WILL EAT THEIR LUNCH IN THEIR DESIGNATED I.S.S. AREA ONLY.

8. BATHROOM USE AND GETTING WATER:
THIS WILL BE DONE ONLY WHEN STUDENT IS ESCORTED BY A MEMBER OF THE STAFF, AND ONLY AFTER THE REC ROOM IS CLEAR OF ALL OTHER STUDENTS. ANY STUDENT WHO LEAVES THEIR DESIGNATED AREA UNESCORTED WILL BE REGARDED AS “NON-COMPLIANT” WITH THE ADDITIONAL DAYS BEING ADDED TO THEIR STAY.

9. ANY HOURS, WHOLE DAYS, PART-OF-DAYS (TARDIES, ETC.) MISSED WILL BE MADE UP.
